Terms of Service

IPG ClearCheck is a service of IPGateway, a division of PS Not Just Another Agency B.V., registered at Laan van Kronenburg 14, 1183 AS Amstelveen, Chamber of Commerce number 55023533, VAT number NL851533681B01 ("IPG", "we"). You can reach us at info@ipgateway.io.

IPG ClearCheck scans a brand name or company before you sign a licensing or commercial agreement. A scan consults public sources — including trademark registers, company registers, insolvency registers, the EU sanctions list and domain registries — and produces a score from 0 to 100 with findings.

You can use the service without an account. The free indication shows the score, the advice band, the trademark owner and how many findings there are per level of seriousness — not what they are. A full report contains the results per source, the check of the trademark owner and an overview of the sources consulted, as a PDF. There is no free PDF.

IPG ClearCheck flags risks based on public sources at the time of consultation. This report does not replace legal advice or a full due diligence investigation. Matches should always be verified.

• A report is a snapshot of the sources at the moment they were consulted. Registers can change immediately afterwards.
• Sources can be temporarily unavailable or not (yet) connected. Such sources are not used for the score; the report states how many checks were carried out across how many source systems.
• Matching on names can miss relevant entries or show entries that concern another party. Every match must be verified with the original source.
• The score is an indication weighted by severity and relevance. It is not a legal assessment and not a decision on whether to enter into an agreement.
• We do not guarantee that a report is complete, accurate or suitable for a particular purpose.

IPG ClearCheck consults official European and national registers only. The full list of sources consulted for a report is not included in the report. Where a report with a professional review by a trade mark attorney is purchased, this list can be inspected during the advisory meeting. The ClearCheck methodology and weighting are protected as a trade secret and under database rights.

The free indication costs nothing. A full report costs the price shown before payment (currently €19), including VAT where applicable. There is no subscription: you pay per report.

Payment is handled by Stripe. We do not receive or store your card details. For business customers in the EU, VAT is calculated according to the applicable rules; you receive an invoice with your billing details and, if you provide one, your VAT number.

After successful payment, the full report is generated immediately and downloaded in your browser. The report is based on the scan you ran; it cannot be used for another scan. You can download the report again for 90 days via the link on your invoice or after payment; after that, the report is no longer available.

If the report cannot be generated after payment, contact us at info@ipgateway.io with the date and brand name. We will provide the report or refund the payment.

The service is primarily intended for businesses. If you use it as a consumer in the EU, you normally have a 14-day right of withdrawal for digital content. By ordering a full report, you expressly request immediate delivery and acknowledge that your right of withdrawal lapses once the report has been delivered.

This does not affect your rights if the report is not delivered or is defective.

You may use IPG ClearCheck to assess brands and business partners. You may not:

• run automated or mass scans (for example with scripts or bots), or overload the service or its sources;
• use the service or reports for unlawful profiling of individuals, harassment or discrimination;
• resell or publish reports as a data product without our written permission;
• circumvent security measures or the link between a payment and a scan.

We may restrict access if we reasonably suspect misuse.

Decisions based on a report remain your responsibility. Our total liability for any claim relating to the service or a report is limited to the amount you paid for the report concerned. We are not liable for indirect or consequential damage, such as lost profit or missed deals.

These limitations do not apply to damage caused by our intent or gross negligence, or where the law does not allow limitation.

The software, design, texts and scoring method of IPG ClearCheck belong to IPG or its licensors. You may use a report you ordered for your own business purposes, including sharing it with your advisers and the parties involved in the deal. Data from public registers remains subject to the terms of those registers.

We may change the service and these terms. The version published on this page at the time of your scan or order applies. Material changes will be announced on this page.

These terms are governed by Dutch law. Disputes are submitted to the competent court in Amsterdam, unless mandatory law gives consumers the right to go to the court of their place of residence.
